You Be the Jury 2023

PROGRAM DESCRIPTION: The You Be The Jury 2023 uses a case-based format to teach principles of medical malpractice. Actual Otolaryngology malpractice cases that have been litigated in court will be presented. Cases will be presented along with expert testimonies, legal principles, and recommendations from an experienced medical malpractice attorney. An interactive approach will be utilized so that the audience will have the opportunity to weigh-in on key decisions during the case, expert opinions, and the ultimate outcome of the trial. This session will provide education on the anatomy of a medical malpractice case and the legal principles that govern the standard of care. Malpractice cases are often great sources of learning and this session will provide education on how to anticipate and avoid ending up in the courtroom as a defendant.

OUTCOME OBJECTIVE 1: Understand legal principles of medical malpractice: standard of care, informed consent, patient harm, and legal discovery.

OUTCOME OBJECTIVE 2: Identify potential pitfalls inherent to the practice of otolaryngology which may lead to adverse outcomes or put patients at excessive risk

OUTCOME OBJECTIVE 3: Learn ways to minimize risk of malpractice in the everyday practice of otolaryngology

BACKGROUND STATEMENT: Medical malpractice is an important topic for all practitioners but is rarely taught in CME format. Understanding medical malpractice allows clinicians to decrease risk to patients and prevent unwanted claims.
